Bail plea of Gustad, team members deferred to June 10

A local court in Mumbai today deferred till June 10 the bail plea of film director Kaizad Gustad and his colleagues Ashish Udeshi and Hadley D'mello, arrested in connection with the accidental death of upcoming director Nadia Khan even as the accused contended they had been wrongly booked under IPC for culpable homicide not amounting to murder.

The railway magistrate A B Rahule adjourned the matter to June 10 as the remand period of all the three accused was to expire on that day.

The magistrate also asked the prosecution to file their say on June 10 on the bail petitions.

Meanwhile, the victim's family has sent a letter to Gustad seeking inspection of documents including permission from railway to shoot for a film on the tracks and insurance cover, if any, for the staff working on the shooting schedule.

Defence lawyer Sayaji Nangre contended that 304 part two IPC (culpable homicide not amounting to murder) was not applicable to the accused. He said police had booked them for the offence of causing death by negligence (section 304 A IPC) but the court had rejected this charge and instead applied the charge of culpable homicide not amounting to murder.

The accused submitted that their custody was no longer required as police had already recorded their statements and there was no recovery of any incriminating material from them.

According to police, Nadia was hit by a speeding train on May 25 when shooting of Gustad's film "Bombay Central" was in progress at Mahalaxmi railway station. However, Gustad's assistant, Ashish Udeshi, had filed a police complaint saying Nadia was killed in a road mishap.
