HOME | SCOOP!! & NEWS | HAPPENINGS Deepa Mehta gets HC notice on 'Water'24th Aug 2005 09.02 IST By Agencies The Delhi High Court on Tuesday issued notices to filmmaker Deepa Mehta and a Canadian company on an application seeking to restrain them from releasing their controversial film Water at the Toronto International Film Festival next month. Justice Anil Kumar, who refused to pass any interim orders on the application moved by Anuradha Dutta, asked Mehta and Flagship International Ltd. to file their replies by November 8, when the film maker's suit is already fixed for hearing. 
In her application filed through counsel Tarkeshwar Nath, Dutta, one of the four defendants in the suit, submitted that Mehta could not release 'Water' as her suit for a decree of declaration that she was entitled to make the film using the script duly approved by the Ministry of Information and Broadcasting was pending adjudication before the court. In the suit, Mehta had claimed that her using the said script did not amount to infringement of copyright of Bengali author Sunil Gangopadhyaya's book "Shei Shomoy" or its English translation "Those Days". In her suit Mehta had also impleaded as defendants Gangopadhyaya, the book's publisher Badal Basu of Anand Publishers, its translator Aruna Chakravarty and Dutta, who edited the English translation. The applicant submitted that she came to know about Mehta's plan to screen the film at Toronto International Film Festival through her statements in the media.
