Karisma’s husband denies deserting her

Industrialist Sunjay Kapur on Wednesday said he did not desert his actress wife Karisma Kapoor and accused her of not returning to their matrimonial home in the capital without any reason.

In his reply to Karisma's affidavit, Kapur denied the allegation of "constructive desertion" and said it was wrong to say that she had any good or sufficient reasons, which compelled her to reside in Mumbai. He accused Karisma of unfairly denying him and Samaira each other's love and affection.

Kapur also denied his petition against Karisma was a crude attempt to seek redress of matrimonial issues of a disgruntled husband by using their minor daughter as a pawn and accused the actress of deliberately raising matrimonial issues in an attempt to sidetrack the real issues.

Instead of addressing the issues raised in his writ petition, she has "deliberately urged fabricated and false matrimonial issues", he said in his affidavit.

Kapur expressed shock over Karisma's allegation he did not make any financial contribution towards her medical and other expenses and the child, claiming she was aware that he had taken care of all her expenses within India and abroad, including making payments towards some film producers who she owned money.

Kapur said he was ready to reimburse all expenses Karisma might have incurred on Samaira. However, if the actress expected him to run her mother's house while he was already running the expenses of the matrimonial home, it would be "totally unjustifiable".

Accusing Karisma of using the media to influence public opinion and interfere with administration of justice, Kapur also requested the Delhi High Court to hear his petition against the actress 'in camera' saying adverse publicity could harm the interest of their five-month-old daughter Samaira.

Kapur complained that even before he had an opportunity to open it, the same was flashed on all major news channels.

"So much so that copy of the actual counter was being shown on television. It was even more curious to see that same portions of the counter had been highlighted and were being shown on various television channels.

"The fact clearly establishes that the Respondent No.4 (Karisma) or her agent had highlighted portions of the counter before releasing the same to the media," Kapur said.

"The only intention of such improper course of action can be to prejudice the case of the petitioner and seek to influence public opinion. The matter relates, inter alia, to the welfare of a minor child and as such this adverse publicity harms the interest of the child," he submitted.

Kapur said Karisma's conduct caused "great distress" to him, as it was "clearly detrimental to the welfare of the baby".

Alleging Karisma's course of action as "contemptuous", he said it amounted to interference with administration of justice. "It appears Respondent No.4 (Karisma) has greater faith in the process of the media rather than process of this court," Kapur said in his rejoinder filed through counsel Manali Singhal.
