Maxim apologizes to Khushboo

The English magazine 'Maxim', in the eye of a storm over publishing a photograph of Tamil actress Khushboo in a bikini, on Thursday said they had apologized telephonically and in the mass media and had offered two more options to her on February 6 to arrive at an amicable settlement over the issue.

Xavier Colaco, president of Media Transasia, representing Maxim, in a press release in Chennai, said that the magazine had offered to carry an apology of the same size as 'the 100 per cent fake piece' that has distressed the actress, in a future issue.

This would be carried with one of the two options offered - Maxim carrying a suitable advertisement in a local English and vernacular newspaper, expressing the editor's and publishers regret for having inadvertently hurt Khushboo's feelings and Khushboo issuing a statement, accepting the apology and issuing a joint press statement in apology for the distress caused, which will include its acceptance.

Khushboo's lawyers had confirmed receipt of the communication, he said He said the picture had a categorical disclaimer titled '100 per cent fake', clearly establishing that it was not an original and also underlining the non-malafide intent of the magazine. Since the picture was stated as fake, Maxim had clearly not trespassed any law, he said.

"However, we feel that the actress resentment may be justified, since we had unwittingly, unintentionally given her offense and had not cleared the picture with her, though a headline picture and a badge prominently declared the entire page to be fake," he said.

Khushboo had earlier on Thursday sent legal notices to the editor and publisher of the magazine, seeking a compensation of Rs three crore within three weeks and said she was not willing to accept any apology from them.
