Come June 10, the law will decide whether Bollywood superstar Salman Khan should be tried for the stricter charge of culpable homicide in the 2002 hit-and-run case.

On Wednesday, May 8, Additional Sessions Judge U B Hejib heard the arguments of both the prosecution and defense over whether Salman Khan's case is fit to be tried under Section 304 (ii) of the Indian Penal Code, which is culpable homicide not amounting to murder. It’s a much stringent charge and under it the guilty can be punished for 10 years.

So far, Salman Khan has been booked only for causing death due to rash and negligent act (Section 304(a) of the IPC) which invites jail term of up to two years and/or fine.

The hit-and-run case dates back to 2002 when on the night of September 28, Salman Khan ran his car over people sleeping on pavement outside a bakery in Bandra. One person was killed and four injured. The actor was said to be driving under the influence of alcohol.

The superstar’s lawyer has maintained that the case is not fit to be tried under the culpable homicide not amounting to murder charge.
