Salman Khan suffered a big blow in the 2002 hit-and-run case on Monday with Mumbai sessions court dismissing his review petition. The actor will now be tried for culpable homicide not amounting to murder.

It’s a setback for the star because if convicted he could face 10 years in jail. The charge can also be tried under a sessions court.

Salman Khan has been given a month’s time to appear before court.

The 47-year-old actor is being tried for the hit-and-run accident involving his Land Cruiser on September 28, 2002. The SUV, allegedly driven by an inebriated Salman had run over people sleeping on the pavement outside a bakery, leading to death of one person and injuries to four others.

Earlier, Salman Khan was being tried for causing death by negligence (Section 304A of IPC), that provides for a maximum punishment of two years in jail. However, in January 2013, a metropolitan magistrate, after examining 17 witnesses, had brought forth the more serious charge of culpable homicide against the actor.

In March, Salman Khan had appealed for a review of this order. However, his review appeal was rejected by Mumbai court on June 24. The actor will now be tried under a stringent charge.
